Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PigeonVault website, applications and services (together, the “Service”), operated by PigeonVault BV (“PigeonVault”, “we”, “us”), a company registered in Belgium. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 16 years old, or the age of digital consent in your country, to use the Service. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.

To protect the Service against abuse, we operate a one-account-per-person policy and may limit new account registrations from the same network. Notify us immediately at support@pigeonvault.com if you suspect unauthorised use of your account.

2. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms;
• upload content you do not have the right to use, or that infringes another person’s rights;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• interfere with, disrupt, or place undue load on the Service, including automated scraping;
• resell, sublicense or commercially exploit the Service except as expressly permitted.

We may suspend or terminate accounts that violate these rules.

3. Your content

You retain all ownership of the data, pedigrees, images and other materials you upload (“Your Content”). You grant us a limited licence to host, process and display Your Content solely to operate and improve the Service for you (for example, to run optical character recognition on a pedigree you upload, or to generate a PDF). We do not sell Your Content.

You are responsible for maintaining your own backups. You can export Your Content at any time in common formats such as CSV and PDF.

4. Plans, trials & billing

The Service is offered on free and paid subscription plans. Paid plans may begin with a free trial. Where a trial requires payment details, you will not be charged during the trial period, and your subscription will begin automatically at the end of the trial unless you cancel beforehand.

Fees are billed in advance on a recurring basis (monthly or yearly) through our payment processor. All prices are shown inclusive or exclusive of VAT as indicated at checkout. You authorise us to charge your chosen payment method for all fees due. Usage-based add-ons (for example, additional pedigree processing) are billed as incurred.

5. Cancellation

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period, and you will not be charged again after you cancel. We do not provide pro-rated refunds for partial periods except where required by law or under our Refund Policy. On cancellation your data remains available in a read-only state for a grace period so you can export it.

6. Intellectual property

The Service, including its software, design, and branding, is owned by PigeonVault and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to copy or reverse-engineer the Service.

7. Availability

We work hard to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, and we perform maintenance from time to time. The Service is provided “as is” and “as available” to the fullest extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by applicable law, PigeonVault is not liable for indirect, incidental or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law, including your statutory rights as a consumer. Our total aggregate liability is limited to the amount you paid to us in the twelve months preceding the event giving rise to the claim.

9. Governing law & disputes

These Terms are governed by the laws of Belgium, and any disputes fall under the jurisdiction of the competent Belgian courts of our registered seat. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts. Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform.
